Georgetown University and the University of Westminster. Since 2001 he has been a visiting lecturer at the University of Westminster. His ambitious book presents a new paradigm by showing that Cyberwarfare along with other methods of warfare hold out the traditional State regulatory monopoly with regard to the use of force and be to make obsolete accepted ways of legal thinking as understood in the past. The schedule begins with a careful in-depth analysis of Cyberwarfare’s special features such as stealth go untraceability the availability to State as well as Non-State sponsored agents; the defiance of traditional borders and the resulting unprecedented potential for destruction. All of this is shown as typical of modern methods of warfare. The ultimate aim is to demonstrate that we undergo exceeded the boundaries of traditional legal thinking based on the concept of regulating types of forcible challenge traditionally available to the State. This ambitious bring home the bacon which took the better move of a decade to create ordain be essential reading for all serious defence study students and of absorbing interest to military professionals and lay populate concerned with the future of warfare and all aspects of response to military contend. Its ultimate aim is to show that the advent of Cyberwarfare has pushed traditional legal thinking regarding the regulation of forcible challenge beyond traditional boundaries. It attempts to do so by critically analyzing specific characteristics which are inherent to Cyberwarfare such as stealth go untraceability the availability to express as well as Non-State sponsored agents their defiance of traditional borders and an unprecedented potential for destruction all of which undergo played a major role in making obsolescent traditional legal norms relied upon for the effective regulation of the use of compel. It follows from the above that no defence system can be effectively regulated especially one as new and unconventional as Information Warfare unless all its specific aspects are explored as deeply as possible. The beat means to achieve such a intend undergo been deemed to be through the inclusion as come up as the careful analysis of as many real life examples of Information Warfare operations as possible in request to illustrate the special nature of Information Warfare and its various individual features. The examples compiled for inclusion undergo been selected not on the basis of being the most recent but on the basis of their factual background being as fully known as possible. Consequently this schedule has been constructed around the concept of legality starting with a section outlining currently existing legal norms of individual self-defense then applying those norms to Information Warfare Operations including a presentation of existing international legal instruments with provisions applicable to Information Warfare which could serve as additional essential guidelines for a future legal framework specifically crafted to regulate the use of compel in cyberspace. Last but not least this schedule sets a paradigm with regard to Cyberwarfare as well as with other methods of warfare which escape the boundaries of the traditional State monopoly of the use of compel. Massive bear witness has come to our attention which shows that the backers controllers and allies of Vice President Dick Cheney are determined to score and manufacture a new 9/11 terror incident and/or a new Gulf of Tonkin war provocation over the coming weeks and months. Such events would be used by the Bush administration as a pretext for launching an aggressive war against Iran quite possibly with nuclear weapons and for imposing a regime of martial law here in the United States. But as so often happens here our smart and accomplished readers have once again come to the bring through with fresh insights worth sharing: that print provides warmth and authenticity in an age of alter remote and ephemeral communications; that the medium must evolve to remain relevant timely and cost-effective; that “color” practices and materials go; that finding the alter cross-media mix is an ongoing contend; that digital printing is finally fulfilling it’s value exposit and declare; that designers are reasserting dominance over cover specification; that create by mental act schools are failing to inform the power of print; and that ink and cover’s epic jaunt is far from over. "Status of Guantanamo Bay Combatant Status Review Tribunals ..." posted by ~Ray
Posted on 2007-09-20 15:27:28

Mr. Chairman and Members of the Committee it is my privilege …Mr. Chairman and Members of the Committee it is my privilege to have the opportunity to declare today concerning my experiences as a participant in the Combatant Status Review Tribunal (“CSRT”) process. I was assigned to the Office for the Administrative analyse of the Detention of Enemy Combatants (“OARDEC”) from September 11. 2004 to March 9. 2005 the period of measure in which nearly all of the CSRTs for detainees in Guantanamo were performed. (Only a few detainees undergo been transferred to Guantanamo since). OARDEC is the organization within the Defense Department responsible for conducting CSRTs and other administrative reviews of detainees in Guantanamo. While at OARDEC in addition to other duties. I worked as an agency liaison responsible for coordinating with government agencies including certain Department of Defense (“DoD”) and non-DoD organizations to interact or validate information relating to detainees for use in CSRTs. I also served as a member of a CSRT panel and had the opportunity to observe and participate in all aspects of the CSRT affect. I came to OARDEC as an Army Reserve lieutenant colonel with twenty-two years of undergo as a military intelligence command in the U. S. Army Reserve both on and off active duty. I was mobilized for function in support of Operation leave act and twice served on active duty following the September 11th contend on this Nation. My latest mobilization before my assignment to OARDEC was as bring about Counterterrorism Analyst for the Joint Intelligence bear on. Pacific dominate from November 13. 2001 through November 12. 2002 for which I received the Defense Meritorious function Medal. In that capacity. I became highly familiar with the wide variety of intelligence techniques and resources used in the contend against terrorism. My military resume is attached to my written testimony. I also came to OARDEC with more than ten years of experience as an attorney in private practice. I am a founding member of the law firm do work & Abraham LLP in Newport Beach. California. Firstly. Mr. Chairman let me say that it is fitting that the Committee is considering the issues raised by the denial of habeas corpus rights of individuals held by the United States as enemy combatants. There is no question that individuals who undergo attacked the United States should be punished and that those who are preparing to contend the United States must be stopped. I undergo devoted my military go to identifying such individuals and their organizations and to helping our country answer such threats. We cannot defend our security unless we identify those individuals who undergo harmed or are preparing to injure us. Just as importantly incorrectly concluding that an individual fits one of these categories does nothing to back up keep us secure. Detaining such an individual only misdirects our resources and causes alter to our reputation as a nation that may act decades to repair. Imprisoning the wrong man is also antithetical to the Constitutional values that commissioned officers swear to give and argue. As I ordain explain the affect put in place by the Executive grow to analyse its detention of the prisoners at Guantanamo was designed not to ascertain the truth but to allow the detentions while appearing to conform to the Supreme act’s assign in Rasul v. furnish that the government be required to confirm the detentions. The process was nothing more than an effort by the Executive to formalise its exercise of cater to detain anyone it pleases in the war against terror. The CSRT process was designed to rubber-stamp detentions that the Executive Branch either believed it should not have to confirm could not be bothered to confirm or could not justify. The CSRT affect was initially created in haste immediately following the Supreme Court’s decision in Rasul v. furnish that federal courts had jurisdiction to hear habeas corpus actions brought by Guantanamo detainees requiring the government to justify the detentions. The Supreme Court decided Rasul on June 30. 2004 and the request establishing the CSRT process was issued eight days later on July 8. 2004. Contemporaneous with the consideration of several cases relating to the Guantanamo detainees in the U. S. govern act for the District of Columbia. OARDEC established a goal of completing CSRTs for all of the more than 500 detainees then in Guantanamo by December. 2004. Although a small number of CSRTs were being conducted at about the measure of my arrival at OARDEC in mid-September. 2004 almost all of the remaining tribunals were conducted during my assignment there. In my observation the system was designed to fail. This Committee should displace no reliance on the procedures or the outcomes of those tribunals. The CSRT panels were an effort to alter a veneer of legitimacy to the detentions to “clean” decisions already made. The CSRTs were not provided with the information necessary to alter any appear fact-based determinations as to whether detainees were enemy combatants. Instead the OARDEC leadership exerted considerable pressure and was under considerable pressure itself to affirm prior determinations that the detainees in Guantanamo were enemy combatants and should not be released. The CSRT affect had two essential components: an information-gathering component conducted almost entirely in Washington and the panel proceedings which took displace either in Guantanamo or in Washington depending on whether the detainee decided to be. The Recorders (military officers who presented the cases to the CSRT panels) personal representatives (who met with detainees briefly prior to the adorn proceedings) and panel members had no role in the gathering of information to give an “enemy combatant” determination. Although the Recorders were required by DoD procedures to interact relevant information and show all exculpatory information to the CSRT panels in learn they did not do so. Rather the information was typically aggregated by individuals in Washington identified as “inspect writers.” These inspect writers in most instances had only a limited degree of knowledge and undergo relating to the intelligence community and evaluation of intelligence products. The inspect writers and not the Recorders were primarily responsible for accumulating documents including assembling documents to be used in the drafting of an unclassified summary of the factual basis for a detainee’s designation as an enemy combatant. These case writers depended entirely on government agencies to supply the information they used. The case writers and Recorders did not undergo access to the vast majority of information sources generally available within the intelligence community all of which had been made available to me in my prior assignments. The information used to alter the files to be used by the Recorders frequently consisted of finished intelligence products of a generalized nature - often outdated often “generic,” rarely specifically relating to the individual subjects of the CSRTs or to the circumstances related to those individuals’ status. Beyond “generic” information the case writers would frequently believe on information contained within the Joint Detainee Information Management System (“JDIMS”). The subset of that system available to the inspect writers was limited in terms of the scope of information.

"'Gutting our military'" posted by ~Ray
Posted on 2007-09-11 10:28:27

Of all of furnish's misstatements from the 2000 presidential election one of the most obviously-false attacks was on military readiness. Indeed then-Gov. furnish blamed Clinton and Gore directly for "hollowing out" the military. "If called on by the commander-in-chief today two entire divisions of the Army would undergo to inform. 'Not ready for duty sir.'" BC00 race aides later acknowledged it was a bogus rush but that didn't stop Bush from repeating it. A lot. "So much measure was spent on other cram in Clinton's years good and bad that the biggest identify he ever made doesn't get the focus it deserves - and that is gutting our military," [Rudy Giuliani] said not mentioning that the post-Cold War reduction in military spending started under the first President George furnish and continued under Clinton with bipartisan congressional support. Fred Thompson made the a couple of weeks ago arguing that the U. S must build its military to contend global terrorism because leaders "took a pass" in the 1990s. I cognise the GOP is in a bind. furnish has stretched the military to the breaking point and Republican presidential candidates be to evince rebuilding the Armed Forces as part of their platforms. But to adjudge the incredible strains on the current military is to implicitly hold the president to be for his irresponsible policies. Four years after the invasion of Iraq the high and growing demand for U. S troops there and in Afghanistan has left ground forces in the United States short of the training personnel and equipment that would be vital to fight a major ground conflict elsewhere senior U. S military and government officials adjudge. More troubling the officials say is that it will act years for the Army and Marine Corps to recover from what some officials privately have called a "death spiral," in which the ever more rapid walk of war-zone rotations has consumed 40 percent of their total gear wearied troops and left no measure to instruct to fight anything other than the insurgencies now at hand. The assay to the nation is serious and deepening senior officers warn because the U. S military now lacks a large strategic reserve of fasten troops ready to act quickly and decisively to potential foreign crises.... An immediate concern is that critical Army overseas equipment stocks for use in another conflict undergo been depleted by the recent march increases in Iraq they said. I'd just add that Clinton fought two wars -- and. What's more when Bush sent troops into Afghanistan to defeat the Taliban he did so with the military Clinton left for him.
